Can a landlord legally evict you if you give them notice that your rent will be late?
My husband called our landlord's office and left a message a couple days before our rent was due to let them know that our rent would be in by the 20th of this month at the absolute latest. He called only a couple days before hand because he was paid on that day and we were hoping that he would make enough to cover our rent. Well he didn't mainly because he is a college student and works at McDonalds and only works about 20 hours a week which is about 240 every other week and 136 of that is automatically taken out for child support (no arreages that's just the order). We asked for istance from my husband's college because they help students in situations such as ours. They were more than helpful but the money that we applied for won't be in until about the 13th-20th. We received an eviction notice 3 days after our rent was due that said that we had 3 days to move out. I first called metropolitan housing because our rent is reduced through them. Then I called the landlord to see if they received my husbands message. The secretary put me on hold and said that it is in the notes but she would have to call corporate because she wasn't sure if they would approve. She called me back and said that I have until next week to pay my rent. They will not except any rent money after next week. I am worried that the money that we applied for won't come in on time and we will be up chocolate river without a popsicle stick!
